There are two spouse visas that allow your spouse to live and work in the United States and eventually apply for U.S. citizenship. Here’s the CR1 and IR1 difference.

CR1 Visa (Conditional Resident): This is for spouses who have been married for less than two years when their visa is approved. It grants the spouse conditional permanent residency in the United States for two years. Before the two-year period ends, the couple must file a joint petition to remove the conditions and convert the visa to an IR1.

IR1 Visa (Immediate Relative): This is for spouses who have been married for more than two years at the time their visa is approved. It grants the spouse immediate permanent residency in the United States without any conditions, so there’s no need to file to remove conditions after two years.

The U.S. Spouse Visa Application Process Overview

Navigating the CR1/IR1 visa process can take about 16 to 24 months. HBM Law is here to guide you through every stage. Here’s the step-by-step process.

Apply to U.S. Citizenship and Immigration Services (USCIS)

First, you’ll submit your immediate relative petition (I-130 form) to USCIS. You will need to submit a preponderance of evidence that your relationship is bonafide (genuine).

Review by the National Visa Center (NVC)

Once it is approved by the USCIS, your application moves to the National Visa Center. They’ll take another look at your relationship, your spouse’s background, and your ability to support your partner financially. You might need to provide some additional details.

Interview at the U.S. Embassy

After NVC approval, your application heads to the U.S. Embassy. Your spouse will need to arrange for medical and criminal background checks and schedule an in-person interview with a consular officer at the embassy.

Obtain the CR1/IR1 Visa

If everything goes smoothly, your spouse will get their visa within two to seven business days after the interview and free to travel with you to the United States to start this new chapter together.

What Happens Next

You can enter the United States as a legal permanent resident and receive the green card to your home address within two months of entering the country.
